These Terms of Service (“Terms”) govern your use of the TVET School Asia website, online store, courses and related services. The services are operated by Marwin Innovation Sdn Bhd (Company No. 1268994-H), trading as EDUK8U® Grad School Asia (“EDUK8U”, “we”, “us” or “our”). By accessing the website, creating an account or purchasing a course, you agree to these Terms.
1. About our services
We provide information about, sell access to and support education and training products. Some programmes may be delivered, assessed, certified or awarded by a partner institution. The relevant course page, offer letter or enrolment documentation will identify the provider and any additional terms that apply.
2. Eligibility and account responsibility
You must provide accurate, complete and current information when creating an account or placing an order. You are responsible for keeping your login details confidential and for activity performed through your account. Please notify us promptly at info@eduk8u.com if you believe your account has been accessed without permission.
If you are under 18, you may use the services only with the involvement and consent of a parent or legal guardian, where required by applicable law.
3. Course information and enrolment
We aim to keep course descriptions, schedules, entry requirements, fees and availability accurate. Course content, instructors, schedules or delivery arrangements may change where reasonably necessary. Your place is not confirmed until any required eligibility checks are completed and payment is accepted.
Purchasing a course does not guarantee admission, certification, employment, immigration outcomes, professional registration or any other result unless expressly stated in writing.
4. Prices, currency and payment
Prices are displayed in the currency selected for your market and include or exclude applicable taxes as indicated at checkout. You authorise us and our payment service providers to process the amount shown before you place the order. Payments may be subject to the payment provider’s own terms and security checks.
If a price or course description contains an obvious error, we may contact you to confirm the correct details or cancel the affected order and issue any refund required by law.
5. Course access and licence
After successful payment and enrolment, we grant you a limited, personal, non-exclusive, non-transferable and revocable right to access the purchased course for the access period stated on the course page or in your enrolment documents.
You must not share, sell or transfer your account; copy, record, redistribute or publicly display course materials except as permitted in writing; bypass access controls; or use course content for unlawful or commercial purposes.
6. Acceptable use
You must not misuse the website or services, introduce malicious code, interfere with security or availability, attempt unauthorised access, impersonate another person, submit unlawful or infringing material, harass other users, or use automated tools to extract content without our written permission.
7. Intellectual property
The website, branding, software and course materials are owned by or licensed to us and are protected by applicable intellectual-property laws. These Terms do not transfer ownership to you. Any rights not expressly granted are reserved.
You retain ownership of original work you submit. You permit us and the relevant education provider to store, review and use that work as reasonably necessary to deliver, assess and administer the course.
8. Partner and third-party services
Our services may link to or depend on learning platforms, payment processors, communication tools and partner institutions. Their separate terms and privacy policies may apply. We are not responsible for third-party services outside our reasonable control, but this does not exclude any responsibility that cannot lawfully be excluded.
9. Cancellations and refunds
Refund eligibility is governed by our Refund and Returns Policy, the specific terms shown for the course and any rights available under applicable law. If there is a conflict, mandatory consumer rights will prevail.
10. Suspension and termination
We may suspend or terminate access where reasonably necessary to protect users or systems, comply with law, address non-payment, or respond to a serious or repeated breach of these Terms. Where appropriate, we will provide notice and an opportunity to resolve the issue. Terms concerning payment obligations, intellectual property, liability and dispute resolution continue after termination where relevant.
11. Service availability
We take reasonable steps to keep the services available and secure, but uninterrupted or error-free access cannot be guaranteed. Maintenance, updates, internet failures and events outside our reasonable control may temporarily affect availability.
12. Disclaimers and liability
To the extent permitted by law, the services are provided on an “as available” basis. We do not exclude or limit guarantees, rights or remedies that cannot legally be excluded. Subject to those rights, we are not liable for indirect or consequential loss arising from your use of the services. Any limitation will apply only to the maximum extent permitted by applicable law.
13. Privacy
Our Privacy Policy explains how we collect, use, disclose, retain and protect personal data.
14. Changes to these Terms
We may update these Terms to reflect changes to our services, business practices or legal obligations. The revised Terms will be posted on this page with an updated date. Where a change materially affects an existing purchase, we will provide reasonable notice where required.
15. Governing law
These Terms are governed by the laws of Malaysia. Any mandatory rights available to you under the laws of your place of residence remain unaffected.
